The Anguilla Inland Revenue Department (IRD) issued a public announcement reminding all providers of commercial rental spaces of their obligation under the Goods and Services Tax (GST) Act. The announcement includes a list of properties that fall under the GST scope and exemptions.

Businesses must register properly for GST by November 18, 2024. After that date, the IRS may impose penalties and fines on taxable persons who breach the GST Act.

Commercial Rental Spaces and GST

Commercial rental spaces are any properties leased or rented for business purposes, including retail, office, and industrial spaces. In addition, hospitality and entertainment venues, mixed-use properties, and parking facilities all fall under the category of commercial spaces subject to GST.

Under the GST Act, renting or leasing commercial spaces is considered a taxable supply and thus requires GST registration in Anguilla. The obligation to register for GST applies to all businesses that provide rental spaces, regardless of the type of lease or duration.

The GST registration threshold is ECD 300,000 (around USD 110,000), meaning those with lower rental income do not have to register for GST.

Another requirement imposed on providers is obtaining a valid business license to operate in the commercial spaces market. Taxable persons can initiate the GST registration process or obtain a valid business license by visiting the IRD office or emailing IRD.
