Anguilla - Mandatory GST Registration for Short-Term Rental Providers
The Inland Revenue Department of Anguilla, a small self-governing overseas territory of the United Kingdom in the Caribbean famous for its beaches and vibrant coral reefs, published a press release directed at short-term rental providers and platforms such as Airbnb, VRBO, and others.
The public notice aims to inform and remind all providers and platform operators of their obligations under the GST Act.
Impact on the Short-term Rental Providers
Under the GST Act, all short-term rental providers must register for GST purposes, regardless of which platform they use, and obtain a valid business license to comply with all rules and regulations. Operating without this license or not registering for GST may lead to penalties, fines, or other legal sanctions imposed on operators and providers.
The Inland Revenue Department (IRD) wants to ensure that all market players respect the rules and register for GST. The IRD warned platform operators that if they do not register for GST and obtain the required licenses, they will breach the laws and face legal actions initiated by the IRD. The deadline for fulfilling these requirements is October 1, 2024, after which the IRD will begin issuing notices to those who still need to comply.
All those who still need to meet these requirements can initiate the GST registration process or obtain the business license by visiting the IRD office or contacting the IRD by e-mail.
Conclusion
Although the obligation to register for GST and obtain a business license exists, and this is not a novelty, the IRD gave all those who are not compliant another opportunity to do so and avoid any further violation of the law that may result in financial penalties.
