Brazil has moved from discussing its consumption tax reform to actively implementing it. Recently, the Federal Revenue Service (RFB) and the Goods and Services Tax Management Committee (CGIBS) issued several key acts establishing the framework for the new tax system. More specifically, the latest legislation establishes Brazil’s timetable for the mandatory issuance of electronic tax documents and the release of the related technical layouts under the Consumption Tax Reform.

Electronic Tax Documents Implementation Timeline

The requirements for the mandatory issuance of electronic tax documents under Brazil’s Consumption Tax Reform are being introduced in phases, with different document types becoming mandatory between August 3, 2026, and January 1, 2027.

The first phase began on August 3, 2026, covering major electronic documents such as NF-e, NFC-e, CT-e, CT-e OS, BP-e, MDF-e, GTV-e, NF3e, DC-e, and NFS-e Via. From October 1, 2026, the requirements expand to include documents such as NFCom, the Remittance Import Declaration (DIR), certain DeRE events, and general municipal-service NFS-e. The first monthly DeRE events for October must be reported by November 15, 2026.

From December 1, 2026, additional NFS-e categories, along with NFGas, NFAg, NF-e ABI, and NF-e issued by non-ICMS taxable persons for IBS and CBS supplies. The final phase begins on January 1, 2027, covering Duimp, monophasic NF-e, NF-e for material-goods imports, and the remaining DeRE events.

Technical Layouts and Compliance Program

The recently published legislation also establishes the XML layouts and validation rules that businesses and software providers must follow when issuing electronic tax documents. Furthermore, the legislation introduces a 2026 compliance program to support businesses during the transition. Under this program, taxable persons that demonstrate cooperative behavior in meeting their ancillary tax obligations will receive additional time to correct or regularize compliance issues.
