UK Updates VAT Reporting Rules for Northern Ireland-to-EU Goods Sales

Following Brexit, HMRC published guidelines in 2020 on reporting goods sales from Northern Ireland to the EU. At the end of February, the HMRC updated the guidelines on completing the EC Sales List (ESL) online and requested confirmation that the ESL had been submitted.
The guidelines provide all the relevant information on who must submit an ESL, when, and what data must be included in the report.
ESL Rules and Requirements
UK VAT-registered businesses must inform HMRC about supplies of goods from Northern Ireland to EU VAT-registered businesses. Depending on the total sales, ESL must be submitted monthly or quarterly. Monthly ESL is required if the total sales in the past four quarters are above GBP 35,000. Nevertheless, quarterly ESL must be submitted if the GBP 35,000 limit is exceeded in each quarter in the last four quarters. Annual ESL may sometimes be allowed, but businesses must meet specific conditions.
Businesses have 21 days after the reporting period passes to submit ESL. Generally, businesses may submit ESL online by completing an online form or uploading a file in CSV or XML format. However, some exemptions to the rule allow ESLs to be submitted in paper form.
Businesses that make errors in their ESL have 21 days to correct them and submit a new one. If the original ESL was submitted by uploading a CSV or XML file, the correction is completed by uploading a new file.

UK businesses registered for VAT purposes, that are involved in the supply of goods from Northern Ireland to the EU must pay close attention to the reporting requirements, and, in cases that they meet conditions for exemption from online submission, contact HMRC and provide the needed data adn request a paper form.
